TDC Conservation Areas

Title Restriction
The sale of the credits from the TDC Conservation Area parcel is always paired with a title restriction created to support the conservation goal (NB: as Title Restrictions are covered in detail elsewhere in this guide, this section mostly serves as a reminder of its role in the TDC Conservation Area). The most common type of title restriction is the conservation easement.
When the TDC program is designed, the program administrator (i.e., the municipality) identifies the point at which the title restriction must be placed. To facilitate the landowner’s ability to sell credits at different times, while still ensuring the required land use restrictions are in place, most programs require that a title restriction be placed once the first credit is actually sold.
